In order to seal or expunge your criminal record in the state of Florida, the following must be true:
- You do not have prior expungements or sealed records
- You have never been adjudicated guilty of a crime
- You are not under court supervision; you are not on probation or under house arrest
- You did not enter a guilty plea to an ineligible criminal offense; ineligible offenses such as homicide, robbery, sexual misconduct etc.
If this is your first offense and your case has been dropped or dismissed, you are most likely eligible to have the record expunged. If a charge resulted in an acquittal or withholding of adjudication, it cannot be expunged until the record has been sealed for at least 10 years first. But charges that were dismissed before trial can be expunged immediately. Florida Statutes Section 943.059 contains a list of charges that cannot be sealed even when adjudication is withheld.
