According to the Wall Street Journal, former Congressman and scandal prone Anthony Weiner, is being investigated by the Feds for exchanging sexually explicit photos with an underage teenage girl. The charges could involve the manufacturing of child pornography. According to the Wall Street Journal, Weiner’s lawyers have had discussions with Federal prosecutors about a possible plea deal in which Weiner would plead guilty to lesser charges.
Depending on the evidence, if Weiner sent or enticed a minor to send sexually explicit photos, that could be enough for a conviction of manufacturing child pornography, which would carry a 15 year minimum mandatory sentence. If the charge was possession of sexually explicit photos of a minor, the charge would carry a 10 year minimum mandatory sentence. Much of it depends on the facts and the number of pictures in question. The actual content and depiction of the pictures could also be a basis for any enhancement of sentence.
Federal prosecutors do not usually bring charges unless the evidence is strong. This would be a high profile case and Federal prosecutors would not want to be on the losing end. They would not charge it unless the evidence was pretty overwhelming. Nonetheless, Mr. Weiner is presumed innocent and the burden of proof rests on the Government.
